Let’s talk about what getting a patent actually costs. Not the watered-down version from online patent mills and “helpers.” The brutal truth.

Getting a patent is hard. The process takes 2-3 years at best. The USPTO rejects most applications before ultimately granting them. Applications that get granted quickly and with no refusals aren’t necessarily good. When it’s a DIY application that has that happen, that usually means it’s so specific it can be easily designed around by competitors.

Professional patentability searches run $1,000-$3,000+.

A properly drafted application can cost $8,000-$20,000+ depending on complexity.

Other costs include:

  • Possible additional searches (like freedom-to-operate) (usually thousands)
  • USPTO filing fees (hundreds to thousands)
  • Office Action response costs (often thousands if examiner meetings and written arguments are necessary)
  • International filing costs (thousands)
  • Maintenance fees (thousands)

A budget of AT LEAST $25,000 is realistic.

If your invention has real commercial potential, the investment is absolutely worth it. Patents can be worth hundreds of thousands or millions of dollars.

But you need to be realistic about the time, money, and complexity.
